Terms and Conditions

The terms governing your use of the KACET website and services

1 Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website www.kacet.co.ke (the "Site") and any related services offered by the Kenya Association for Certified Training Providers for Industry ("KACET", "we", "us", or "our"), including registration, applications for training, Recognition of Prior Learning (RPL), assessment, certification, and membership services.

By accessing or using the Site, submitting an application, or registering as a member or partner institution, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or our services.

2 About KACET

KACET coordinates training, examination, and certification across multiple industry sectors, working in partnership with the National Industrial Training Authority (NITA), the Curriculum Development, Assessment and Certification Council (CDACC), and the Technical and Vocational Education and Training Authority (TVETA). KACET serves artisans and informal-sector ("Jua Kali") workers, training institutions, counties, and donor organisations.

3 Eligibility

To apply for KACET training, assessment, or certification services, you must:

  • Provide accurate, current, and complete information as requested in our Application Form
  • Meet any minimum age, educational, or sector-specific eligibility criteria applicable to your chosen programme
  • Where you are a minor, apply with the involvement and consent of a parent or legal guardian

KACET reserves the right to verify any information provided and to decline or revoke an application where eligibility requirements are not met or information is found to be false or misleading.

4 Applications, Assessment, and Certification

  • Submission of an Application Form does not guarantee admission, assessment, or certification.
  • You are responsible for the accuracy of all information submitted, including personal, educational, and skills-related details. Providing false or misleading information may result in disqualification or revocation of any certification already issued.
  • Certification is issued through KACET's accredited partner bodies (NITA, CDACC, TVETA) and is subject to their respective standards, examination requirements, and timelines, which KACET does not solely control.
  • Processing timelines communicated on the Site or in application confirmations (for example, review within 5–7 working days) are indicative and may vary.
  • KACET may request additional documentation or a portfolio assessment as part of the Recognition of Prior Learning (RPL) process.

5 Membership and Institutional Partnership

Training institutions seeking to register as KACET associate institutions, and counties or donors seeking to partner with KACET on Training Needs Assessments, must comply with any additional membership or partnership terms communicated separately by KACET. KACET reserves the right to set, review, and revise eligibility and compliance criteria for membership and institutional partnerships.

6 User Responsibilities

When using the Site or our services, you agree that you will not:

  • Provide false, misleading, or fraudulent information in any application or communication
  • Impersonate another person or misrepresent your affiliation with any organisation
  • Use the Site for any unlawful purpose or in a way that infringes the rights of others
  • Attempt to gain unauthorised access to the Site, its systems, or data belonging to other applicants or partners
  • Upload or transmit any content that is defamatory, harmful, or infringes intellectual property rights

7 Intellectual Property

All content on the Site, including text, graphics, logos, the KACET name and brand, images, and design, is the property of KACET or its licensors and is protected by applicable intellectual property laws. You may view and print content from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

8 Fees

Where applicable, fees for training, assessment, certification, or membership will be communicated to you separately and are subject to KACET's prevailing fee schedule. Any fees paid are generally non-refundable except as required by law or as expressly stated in writing by KACET.

9 Third-Party Links and Partner Bodies

The Site may contain links to third-party websites or reference third-party bodies such as NITA, CDACC, and TVETA. KACET does not control and is not responsible for the content, policies, or practices of third-party websites or the independent decisions of certifying bodies regarding examination and certification outcomes.

10 Disclaimer of Warranties

The Site and our services are provided on an "as is" and "as available" basis. While we strive to keep information on the Site accurate and up to date, KACET makes no warranties, express or implied, regarding the completeness, reliability, or availability of the Site, or that certification outcomes will meet your expectations.

11 Limitation of Liability

To the fullest extent permitted by law, KACET shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Site, reliance on information provided, delays in application processing, or decisions made by third-party certifying bodies. Nothing in these Terms limits liability that cannot be excluded under Kenyan law.

12 Indemnity

You agree to indemnify and hold KACET, its officers, employees, and partners harmless from any claims, losses, or damages arising from your breach of these Terms, misuse of the Site, or the submission of false or misleading information.

13 Data Protection

Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Site or submitting an application, you also agree to the terms of our Privacy Policy and Cookie Policy.

14 Termination and Suspension

KACET reserves the right to suspend or terminate your access to the Site or any application, membership, or certification process, without notice, where we reasonably believe these Terms have been violated, or where information provided is false, fraudulent, or misleading.

15 Changes to These Terms

We may revise these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.

16 Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Kenya.
